How do I protect my business name?
|
If the business entity type is anything other than Sole Proprietorship or Partnership, you will be registered with the Secretary of State (SOS). The Secretary of State will assure that the entity name is unique in South Carolina. The name you enter will be checked against an SOS database of names. This unique naming process is not indicative of a copyright or trademark.
Sole Proprietorships and Partnerships are registered under the individual's and partner's name respectively and carry no business name registration or protection through the Secretary of State. DBA (doing business as) names are not checked against any databases for uniqueness, copyrights or trademarks. For protection of a business name go here for copyrights and here for trademarks.
